By using CODE 49 and the CRM 49, you agree to these Terms and to our Privacy Policy.

1. About CODE 49

CODE 49 is a Software-as-a-Service (SaaS) platform for real estate agencies and agents — website, CRM, automatic publishing to portals, marketing tools and artificial intelligence. The service is operated by CODE 49 LLC, a company based in Orlando, Florida, United States (“CODE 49”, “we”, “us”). Contact: support@code49.net.

These Terms govern access to the CRM 49, linked websites, hosting, integrations and other features. Using the service means you fully accept these Terms and the Privacy Policy.

2. The Service

The CRM 49 is an online platform accessed over the internet. It may include a real estate CRM, website hosting, operational data storage, external integrations and administrative tools.

The SaaS environment is not a permanent archiving service or a definitive data-storage service.

3. Account and Security

You are responsible for keeping your credentials confidential and for all activity carried out in your account. We are not liable for unauthorized access resulting from your negligence.

4. Subscription and Payment

The service is provided on a prepaid basis. Access remains active exclusively during the paid period. Prices are shown per country and currency.

Non-payment may result in:

• automatic suspension;
• unpublishing of websites;
• interruption of integrations.

5. Cancellation

You may cancel at any time, with no penalty and no minimum term. We ask for at least 15 days' notice before the renewal date for an orderly technical wind-down. Cancellation only prevents future charges.

6. Your Data and Backups

You may request full backups while the service is active. Keeping your own copy of the data is your responsibility.

After termination, data may remain stored for up to 30 calendar days solely for technical contingency, and may then be permanently deleted, with no guarantee of later recovery.

7. Acceptable Use

You may not use the system for fraud, spam or unlawful activity. We may suspend access immediately, and you will be responsible for any damages you cause.

8. Third-Party Integrations

Integrations depend on third parties — including Meta/Facebook, WhatsApp, Google, real estate portals, DNS and external servers — and may change or be discontinued without notice. CODE 49 has no control over such services.

9. Intellectual Property

All software belongs exclusively to CODE 49. Reverse engineering is prohibited.

10. Disclaimers and Limitation of Liability

The service is provided “as is”. We do not guarantee continuous or error-free operation, and we will not be liable for:

• lost profits;
• lost leads;
• drops in search-engine rankings;
• lost sales;
• internet outages;
• failures of third parties (Meta/Facebook, WhatsApp, Google, portals, DNS, external servers).

Our total liability is limited to the amount you paid in the 3 months preceding the event. We are not liable for indirect damages.

11. No Commercial Guarantee

CODE 49 does not guarantee commercial results, lead generation or sales performance arising from use of the system.

12. Changes

We may update the service and these Terms to reflect technical, operational or legal improvements. Continued use of the system after changes are published constitutes acceptance of the new conditions.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States. The courts located in Orlando (Orange County), Florida, will have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer-protection rights that may apply in your country of residence.
